1. Who we are
Frameshot AI (“Frameshot,” “we,” “us,” or “our”) provides an AI-powered creative studio for image, video, audio, and 3D-world generation, available at frameshot.ai. These Terms govern your access to and use of the Frameshot website, web application, APIs, and related services (collectively, the “Service”).
2. Account eligibility
You must be at least 13 years old (or the minimum age required in your country) to create an account. If you are under 18, you must have a parent or legal guardian’s consent. By signing up, you represent that the information you provide is accurate and that you are not barred from using the Service under any applicable law.
3. Subscription plans, credits, and renewals
Frameshot is offered on a tiered subscription model. Each paid plan grants a fixed allotment of generation credits each billing cycle. Credits do not roll over — your balance resets to the plan allotment at the start of each cycle.
- Auto-renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or annual) at the then-current rate until you cancel.
- Cancellation: You may cancel anytime from your account settings. Cancellation takes effect at the end of the current paid period; you keep access until then.
- Price changes:We may change subscription prices, with at least 30 days’ notice via email. Continued use after the change takes effect constitutes acceptance.
- Failed payments: If a charge fails, we will retry within seven days. If we cannot collect, your account is suspended until billing is resolved.
Refunds are governed by our Refund Policy.
4. Your content and ownership
You retain ownership of any prompts, reference images, audio, video, or other inputs you provide to the Service (“Inputs”). To the extent permitted by law, you also own the outputs that the AI models generate from your Inputs (“Outputs”), subject to the third-party model terms disclosed at the time of generation.
You grant Frameshot a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your Inputs and Outputs solely as required to operate, secure, and improve the Service. We do not use your Inputs or Outputs to train our own foundation models without your explicit opt-in.
5. AI-generated content disclaimer
AI generation is probabilistic. Outputs may contain inaccuracies, fictional details, or content that resembles existing works. You are solely responsible for reviewing every Output before using it publicly or commercially. Frameshot does not warrant that any Output is original, fit for any particular purpose, or non-infringing.
Where the underlying model provider asserts copyright or use restrictions on Outputs (e.g. for non-commercial use only), those restrictions flow through to you. We surface relevant provider terms at the time of generation; review them carefully.
6. Acceptable Use
Your use of the Service is also governed by our Acceptable Use Policy, which prohibits, among other things, the generation of CSAM, non-consensual deepfakes of real people, or content that incites violence. Violation of the AUP is grounds for immediate termination without refund.
7. Service availability
We aim for high availability but do not warrant uninterrupted access. The Service is provided “as is” and “as available.” We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice for changes that materially reduce functionality.
8. Termination
You may close your account at any time from account settings. We may suspend or terminate your access if you breach these Terms or the Acceptable Use Policy, fail to pay, or use the Service in a manner that creates risk for Frameshot or its users. On termination we may delete your data after a reasonable retention period — see the Privacy Policy for specifics.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRAMESHOT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRAMESHOT’S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO FRAMESHOT IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER. IN NO EVENT WILL FRAMESHOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES.
11. Indemnification
You agree to defend, indemnify, and hold harmless Frameshot, its affiliates, and their respective officers, employees, and agents from any claim, demand, or expense (including reasonable attorneys’ fees) arising out of (a) your Inputs, (b) your Outputs, (c) your use of the Service, or (d) your violation of these Terms or the Acceptable Use Policy.
12. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in English, in Wilmington, Delaware. You and Frameshot agree that each party may bring claims against the other only on an individual basis and not in any class or representative action.
Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction for actual or threatened infringement of intellectual-property rights.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email or in-product notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
